A11yTrail - Terms of Service
These Terms of Service ("Terms") govern your access to and use of the A11yTrail website, browser extension, and software services (collectively, the "Service"), operated by A11yTrail ("A11yTrail," "we," "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
A11yTrail provides automated web accessibility scanning, scheduled monitoring, alerting, reporting, and documentation tools. The Service identifies potential accessibility issues based on automated testing. Automated testing does not detect all accessibility issues and the Service does not guarantee that any website is, or will become, compliant with WCAG, the ADA, or any other law or standard. You are responsible for evaluating and remediating your (or your clients') websites.
2. Accounts
You must provide accurate information and are responsible for safeguarding your account credentials and for all activity under your account. You must be at least 18 years old.
3. Acceptable use
You agree to scan and monitor only websites that you own or are authorized to test. You may not use the Service to access systems without authorization, to scan sites in violation of their terms, or for any unlawful purpose. You may not resell, reverse-engineer, or abuse the Service except as expressly permitted by your plan (e.g., white-label reporting for your own clients).
4. Subscriptions and billing
Paid plans are billed in advance on a recurring monthly or annual basis through our payment provider and Merchant of Record, Paddle. By subscribing, you authorize recurring charges until you cancel. Plan limits (e.g., number of monitored sites) apply to your tier.
5. Cancellation
You may cancel at any time; cancellation stops future renewals. See our Refund Policy for details on refunds.
6. Intellectual property
The Service, including its software and content, is owned by A11yTrail and its licensors. Reports you generate about your own or your clients' sites are yours to use. The A11yTrail scanning engine incorporates open-source components (including axe-core), used under their respective licenses.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all accessibility issues.
8. Limitation of liability
To the maximum extent permitted by law, A11yTrail will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.
9. Indemnification
You agree to indemnify and hold A11yTrail harmless from claims arising out of your use of the Service or your breach of these Terms, including claims related to websites you scan without authorization.
10. Changes
We may update these Terms; material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-law rules.
